The second class-action lawsuit came late last week - three weeks after filing the first lawsuit for the poor state of Cyberpunk 2077 on PlayStation 4 and Xbox One. The content of the lawsuit states that "the content of the claim, including its subject and scope" is the same as the complaint last December.
Despite garnering positive reviews for PC, the significant bugs and glitches that made Cyberpunk 2077 "unplayable" for the previous generation of consoles forced Sony and Microsoft to offer refunds for disappointed consumers. Even so, that didn't help them as Sony eventually pulled the game from the PlayStation store.
The company has already acknowledged that the release of their latest game, Cyberpunk 2077, was not what they planned. Marcin Iwiński, the co-founder of CD Projekt, issued an apology and expressed commitment to fixing the game before the lawsuit went live. He stated that the current issues players were experiencing with the game didn't come up during testing. He also stated that the development team believed the game was not ready and they had no control over the release of the game. That power rests entirely with the board of directors.
A few weeks after the apology by Iwiński, an article claimed that the demo at E3 was "faked" by the studio. To which studio head Adam Badowski rebutted, "that's what the 'work in progress' is for" following the claim.
The company still does not believe that it has violated any federal laws to which they stated it will "take vigorous actions to defend itself" even though the lawsuit does not state the number of damages sought.
At the moment, the company is under investigation by Poland's Office of Competition and Consumer Protection as they work on fixing the bugs and crashes in the game. As Iwiński stated in his video, CD Project Red will stay true to creating amazing games while valuing continued communication with its player base.
